38-2-17 EASEMENTS. The consumer shall give such easements and
rights-of-way as necessary to the City and allow access for the purpose of
construction, repair, maintenance, meter reading, relocation or expansion of
the water system. The necessity shall be determined by the Superintendent.

For the City council and others who do not know what a easement is, it is written
permission to use ones property for a specific use, water line, power line ect.
Easements can be hard to get from some landowners, but their is a process that
can be used by government bodies to secure easements from unwilling
landowners. It is called eminent domain and is not a easy, quick or sure way (by
design) for government to get the easement or property that they want.
Well the city council thinks that they have found a way around all of that eminent
domain stuff and they just added it to the city code that you are required to give
them any easement that they want. WHAT A JOKE, IN THE USA THEIR IS A
THING CALLED DUE PROCESS AND A LINE OF CITY CODE DOES NOT
TAKE THAT REQUIREMENT AWAY.
